The End of The War

 Usually the following circumstances take place after war.

Signing a peace-pact: Sometimes this pact comes into existence in the following conditions:

Special temporary pact: This means a Muslim soldier gives shelter temporarily to an enemy soldier with the condition that the enemy has surrendered or sought shelter. Similarly, if a group of enemies yields to a group of Muslims, it is allowed to give them shelter if the expedience demands so: for example he wants to get some knowledge of Islam, or Muslims occupy enemies’ weapons through him, or they get information about the war secrets. Such a person will be safe from all kinds of persecutions and he will enjoy the right to be with Muslims temporarily until he has reached his safe place. The decision of such a shelter will be taken by the Muslim ruler. Allah Almighty says:

« وَإِنْ أَحَدٌ مِنْ الْمُشْرِكِينَ اسْتَجَارَكَ فَأَجِرْهُ حَتَّى يَسْمَعَ كَلامَ اللَّهِ ثُمَّ أَبْلِغْهُ مَأْمَنَهُ ذَلِكَ بِأَنَّهُمْ قَوْمٌ لا يَعْلَمُونَ (6)» [التوبة:6]

Translation of Meaning: “And if anyone of the idolaters seeketh thy protection (O Muhammad), then protect him so that he may hear the Word of Allah, and afterward convey him to his place of safety. That is because they are a folk who know not.” [At-Taubah:6]

Common temporary pact: This means the pact which is for temporary ceasefire or which ends with reconciliation. It is necessary to give shelter in two conditions:

One of them is when the enemy has sought shelter. It is necessary to give him/her shelter in this condition. However, such a condition requires much caution and alertness. Allah Almighty says:

« وَإِنْ جَنَحُوا لِلسَّلْمِ فَاجْنَحْ لَهَا وَتَوَكَّلْ عَلَى اللَّهِ إِنَّهُ هُوَ السَّمِيعُ الْعَلِيمُ (61) وَإِنْ يُرِيدُوا أَنْ يَخْدَعُوكَ فَإِنَّ حَسْبَكَ اللَّهُ هُوَ الَّذِي أَيَّدَكَ بِنَصْرِهِ وَبِالْمُؤْمِنِينَ (62) » [الأنفال : 61-62]

Translation of Meaning: “And if they incline to peace, incline thou also to it, and trust in Allah. Lo! He, even He, is the Hearer, the Knower. And if they would deceive thee, then lo! Allah is Sufficient for thee. He it is Who supporteth thee with His help and with the believers.” [Al-Anfal:61-62]

The other condition is that the time is that of months of hurumah (sacred month). It is not allowed instigating a war in these months: Dhu al-Qa’da, Dhu al-Hijja, Muharram and Safar. Yes, if the enemies have started a war in these months, it is necessary to fight them. Similarly, if the war is on, and it enters the months of respect, and the enemy does not accept ceasefire or reconciliation, the war will continue in these months, too.
